Свежий американский скандал с секретным прослушиванием телефонных разговоров американских граждан коренным образом меняет моё отношение к администрации Буша. По-моему, он заслуживает за это получить импичмент. У него была возможность сделать это законным образом, через FISA. Он ей не воспользовался.

Сомневаюсь, что будет импичмент, конечно... посмотрим. Но он его заслужил.

p.5 is very important, because it shows that the administration's legal argument is not such an easy slam-dunk as they try to position it. Therefore, a legal challenge to a broad interpretation of the "all necessary force" has a reasonable chance to succeed. Simply put, it is not a dead issue.

p.6 is also important, because, fundamentally, laws are written not for the courts and lawyers, but for the public, e.g. some of them intend to protect the public from secret government actions. More practically, public pressure on the Congress, please don't forget that 2006 is an election year, will most likely lead to additional scrutiny of the administration's legal position, wider disclosure, leaks, and etc., all of which increase the probability of a broader legal challenge to the NSA program's constitutionality.

As we agreed on p. 2, the law was broken by the Bush administration, and one should not dismiss political implications of this fact, because they bear in a material way on the legal situation.

Пункт 5 - тривиален. Если бы не было правовой коллизии, мы бы не обсуждали этот вопрос вообще, а раз имеется правовая коллизия, всегда найдутся юристы, имеющие строго противоположные мнения по этому вопросу. Если дело доходит до верховного суда, этими юристами с противоположными мнениями оказываются его члены. Главное - что есть коллизия, что изначально не осознавалось (и не осознается) очень многими; например, это видно из постинга, к которому мы пишем эти комменты.

Пункт 6 - здесь нерелевантен, потому что политизируются все действия администрации, будь они законны или незаконны.

Наконец, выясняется, что мы вовсе не согласны по пункту 2. Для меня очевидно, что не соблюдены требования одного конкретного закона; можно ли говорить о не соблюдении требований "закона" вообще (the law was broken) - критически зависит от интерпретации решения верховного суда.

p.5 is not as trivial as you might think. Of course, there's always a difference of opinions, and one can always find a lawyer who's ready to represent either side.
In this particular case, though, one needs a specialist, or a team of specialists, of the highest caliber, whose knowledge and authority on the subject can sway the Supreme Court judges. You won't find this kind of people for a marginal case, where the probability of a legal victory is very low. Here the chances are quite reasonable, and one should think potential plaintiffs will not have a problem fielding a quality team.

p.6 is relevant because the case will be subject to congressional hearings, where due to election politics sensitivity to public opinion is going to be higher than usual. Just wait one month and you'll see how it all happens.

p.2 deals with the FISA law. Even the administration doesn't dispute the fact that this particular law was broken. The question here is whether the "war powers" trump the law, which in Gonzales' opinion has become obsolete.


P.S. I think we are starting to go in circles... Let's state our disagreements and return to this conversation a couple of months from now, when new information becomes available.
