Если же проданное лекарство не только вылечило геморрой, но и отравило Б, то A виноват в прямом агрессивном нанесенении вреда Б - и, опять же, это даёт право Б требовать сатисфакции у A.

If B is already dead, he has inheritors. Who inherit his rights - including the claim for compensation from A. (That much is a common law).

If B has no inheritors or anyone with a claim to his effects, his property (including this right) becomes unowned. Which, in libertarian theory, allows anyone to homestead it. This, in effect, creates an inheritor, and reduces the problem to the previous case.

In fact, most people would create a contract with a protection agency (or a city or a lord) with a stipulation that in case of his death the right to pursue and persecute the criminal will be transferred to the agency - and that in exchange the agency will promise to bring justice to the criminal.

This kind of contracts was rateher common in medieval city-states, and worked quite well.
